These exemptions, which fall under California's Clean Air laws, were created to support investment in lower-emission vessels and port infrastructure.
Background of the Exemptions and Their Importance
For the past fifty years, under both Democratic and Republican administrations, these exemptions have not been recognized as laws. However, recently this dispute has also reached federal court. A federal judge in Washington, D.C. has allowed California to include requests for new exemptions that encompass four exemptions related to the Clean Air Act.

Congress's decisions regarding these exemptions are underway while the federal court is still reviewing the legal status of these permits. Congress is seeking to pass these exemptions that could help improve the shipbuilding industry and protect national investments.
Actions and Outcomes of California's Environmental Programs
The port commercial vessel standards, adopted in 2009 and amended in 2022, include updates for tugboats, passenger vessels, and workboats with clean engines and zero-emission technologies. This standard has a direct impact on the lives of approximately 9.7 million California residents living near areas where commercial vessels operate.
These regulations project that by 2038, diesel particulate pollutants will be reduced by 89% and nitrogen oxides by 54%. California estimates that this program could prevent 531 premature deaths, 161 hospitalizations, and 236 emergency room visits, which will gradually yield about $5.25 billion in health benefits over the regulatory analysis period.
